1. Acceptance of Terms

By accessing or using the LeadPulse website, platform, and related services (collectively, the “Services"), you agree to be bound by these Terms of Service (“Terms"). If you do not agree to these Terms, please do not use the Services. These Terms constitute a legally binding agreement between you and LeadPulse Technologies Private Limited, a company incorporated in India.

2. Description of Services

LeadPulse provides an AI-powered outbound calling and lead qualification platform for businesses. Features include voice agent campaigns, predictive dialling, real-time analytics, CRM integrations, and dashboard reporting. Specific features, limits, and availability are described on our website or in your service agreement.

3. Eligibility

You must be at least 18 years old and capable of entering into a binding contract to use the Services. By using the Services, you represent and warrant that you meet these requirements. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization.

4. Account Registration & Security

You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

5. Acceptable Use

You agree not to use the Services to:

• Violate any applicable Indian law, regulation, or regulatory guideline, including TRAI regulations on telemarketing and unsolicited commercial communications;
• Make calls to numbers registered on the National Do Not Call (NDNC) registry without proper consent or exemptions;
• Transmit any unlawful, harassing, defamatory, or obscene content;
• Interfere with or disrupt the integrity or performance of the platform;
• Attempt to gain unauthorized access to any part of the Services;
• Use the Services for any purpose that is fraudulent or deceptive.

6. Intellectual Property

All content, software, designs, trademarks, and other intellectual property on the Services are owned by LeadPulse or its licensors and are protected by Indian and international copyright, trademark, and other laws. You are granted a limited, non-exclusive, non-transferable license to use the Services in accordance with these Terms. You retain ownership of your data uploaded to the platform.

7. Data & Content

You retain all rights to the data, contact lists, and recordings you upload or generate using the Services (“Your Content"). You grant LeadPulse a limited license to process Your Content solely to provide and improve the Services. We do not use Your Content to train general AI models without your consent. You represent that you have all necessary rights and consents to upload and process Your Content.

8. Payment & Billing

Certain features of the Services may require payment. Fees are described in your order form, service agreement, or as displayed on the website. All fees are quoted in Indian Rupees (INR) unless otherwise stated and are exclusive of applicable taxes. Payments are non-refundable except as required by law or as expressly stated in a written agreement.

9. Limitation of Liability

To the maximum extent permitted by applicable law, LeadPulse shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business interruption, arising out of or related to your use of the Services. Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including breach of these Terms. Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination shall survive.

11. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, the dispute shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.

12. Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email or a prominent notice on the website. Continued use of the Services after changes constitutes acceptance of the revised Terms.
